Defamation of character: Court orders remand of Muazu Magaji

The Kano State Magistrate Court Presided over by Aminu Gabari has ordered the remand of one Muazu Magaji in Correctional Centre for allegedly defaming the Character of Kano State Governor, Dr. Abdullahi Umar Ganduje, his Children, Abdul,ziz Ganduje and Balaraba Ganduje respectively.

According to the First Information Report (FIR) the duo were arraigned for the alleged Conspiracy, Intentional Insult, Inciting Public disturbance and defamation of character contrary to Section 97, 114, 391 and 399 of the Penal Code.

” On the 26th October, 2021 at about 1100hrs one Honourable Auwal Lawal Shuaibu, the Chairman, Nassarawa LGA came to Special Intelligence Bureau (SIB) Kano Command and complaint against you Muazu Magaji Danbala and one Jamilu Shehu who is now at large, all of Sabon Garin Kiru, Kiru LGA, Kano State.

” That on the 26th October, 2021 at about 1100hrs you both conspired and posted on Facebook Platform, the image and portrait of His Excellency, Executive Governor of Kano State including his children Abdulaziz Ganduje and Balaraba Ganduje with a bold written on it ‘ Barayin Kano’ knowing fully well that your action may result to breach of peace of peace within the state and outside”

” You are therefore suspected to have committed the above mention offences”.

The Suspects pleaded not guilty to the charges and thereafter Defense counsel applied for his bail.

The Court refused to admit the suspect to bail after objection by the Prosecution Counsel Barrister Wada Ahmad Wada Principal State Counsel.

The Trial Magistrate, ordered the State Criminal Investigation Department (SCID) Police Headquarters to produce the case diary to enable the court perused it before before determining weather to admit him bail or not not.

The case adjourned to 8th November, 2021 for further mention
